Question 1

Are ESAs “legal” in Delaware?

Accepted Answer

Yes. Delaware’s Fair Housing Act explicitly uses “assistance animal” and “support animal” definitions that match HUD, which includes emotional support animals when needed for a disability-related housing accommodation.

Question 2

Can my Delaware landlord deny my ESA?

Accepted Answer

They can only deny or remove an assistance animal if:

Your documentation is missing or clearly unreliable
The animal is a direct threat to others’ health or safety
The animal is likely to cause substantial property damage
The request is unreasonable given the unit/property (e.g., too many large animals in a tiny space)

They cannot deny you just because of:

“No pets” rules
Breed, weight, or general pet policies
Personal dislike of animals

Question 3

Can Delaware landlords charge pet fees or pet rent for ESAs?

Accepted Answer

No. Under HUD guidance and Delaware’s updated landlord–tenant code, landlords cannot charge pet deposits or extra fees for assistance animals. They can still charge for actual damage beyond normal wear and tear.

Question 4

Are online ESA letters legal in Delaware?

Accepted Answer

They can be, but only if:

A licensed mental health professional who is authorized for Delaware (licensed or interstate telehealth registered) actually evaluates you; and
The letter itself contains the legally expected information.

Question 5

Do ESAs have public access rights in Delaware like service dogs?

Accepted Answer

No.

Under both the ADA and Delaware’s Equal Accommodations Law, public-access rights are for service animals (task-trained dogs), not ESAs. Some businesses voluntarily allow ESAs, but that’s a choice, not a legal requirement.

Question 6

How many ESAs can I have in Delaware?

Accepted Answer

Delaware law does not set a strict number. HUD focuses on reasonableness:

Each animal should play a role in your disability-related support; and
The total request must be reasonable for the property (noise, space, safety, sanitation).

The more ESAs you list, the more detail landlords (and clinicians) will reasonably expect. Also each ESA will need its compliant Delaware ESA letter.

Question 7

Do I need to register my ESA with Delaware or get an ID card?

Accepted Answer

No. Delaware does not require ESA registration or ID cards, and landlords cannot demand special ID as a condition of honoring your ESA.

What matters is:

Your disability-related need, and
Reliable documentation from a qualified provider.

This can include creating or using fake letters, vests, or documents to deceive.
