Understanding Your ESA Rights in California

California ESA Law: AB 468

California's Assistance Animal Integrity Act (AB 468, codified in the Health & Safety Code) sets the rules for issuing ESA documentation. The provider must hold a valid California license and must have established at least a 30-day therapeutic relationship with the client before issuing an ESA letter. With a valid letter, the federal Fair Housing Act — reinforced by California's Fair Employment and Housing Act — requires housing providers to grant reasonable accommodations for an emotional support animal, including in "no-pet" housing, without pet deposits or pet rent.

A landlord may

  • Ask for a letter from a licensed health professional confirming your ESA-related need.
  • Request that documentation when the disability or need is not obvious.

A landlord may not

  • Charge pet fees, pet rent, or a pet deposit for an ESA.
